("we," "us," or "our") through our website (www.designsbytoccara.com) or any other means, you ("you" or "client") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our services.  

2. Services Provided

We offer a range of graphic design services, including but not limited to:

• Logo design and brand identity development

• Marketing material design (brochures, flyers, posters, etc.)

• Social media content design

• Website graphic design

• Custom graphic design projects

• Event Branding that includes:

  • Event logo design

  • Event collateral (invitations, signage, programs, etc.)

  • Event digital assets (social media graphics, website banners, etc.)

  • Event space design concepts (visual mockups)

The specific services provided will be outlined in a separate project proposal or agreement.

3. Project Process

• Consultation: We will begin with a consultation to understand your needs and project requirements.

• Proposal/Agreement: We will provide a detailed proposal or agreement outlining the scope of work, deliverables, timeline, and payment terms.

• Design Process: We will present design concepts and revisions based on your feedback.

• Final Delivery: Upon approval and payment, we will deliver the final design files.

• Feedback: The client is expected to provide timely and constructive feedback during the revision process.

4. Payment Terms

• Payment terms will be specified in the project proposal or agreement.

• We may require a deposit before starting any project.

• Final payment is due upon delivery of the final design files.

• Payments are processed through secure third-party payment processors.

• All prices are in U.S Currency.

5. Intellectual Property

• Upon full payment, we grant you a non-exclusive, perpetual license to use the final design files for their intended purpose.

• We retain the copyright to all preliminary design concepts and unused materials.

• We reserve the right to display the final design files in our portfolio and marketing materials, unless otherwise agreed upon in writing.

• The client is responsible for ensuring that all provided content, including text and images, does not infringe on any third-party copyrights or trademarks.

6. Client Responsibilities

• You are responsible for providing accurate and complete information for your project.

• You are responsible for providing timely feedback and approvals.

• You are responsible for obtaining any necessary permissions or licenses for provided content.

• You agree to use the delivered design files in a legal and ethical manner.

7. Revisions and Changes

• The number of revisions included in the project will be specified in the project proposal or agreement.

• Additional revisions or changes may incur additional fees.

• Changes requested after final approval may incur additional fees.

8. Cancellation and Refunds

• If you cancel a project before work begins, you may receive a full refund.

• If you cancel a project after work has begun, you may be entitled to a partial refund, depending on the stage of the project.

• Refunds are issued at our discretion.

• Deposits are generally non refundable.

9. Limitation of Liability

• We are not liable for any indirect, incidental, or consequential damages arising from the use of our services.  

• Our liability is limited to the amount paid by you for the services.  

• We are not responsible for errors after the final files have been approved by the client. It is the client's responsiblity to proof all files.

10. Disclaimer of Warranties

• We provide our services "as is" and without any warranties, express or implied.

• We do not guarantee specific results or outcomes.

• We are not responsible for printing errors caused by outside printing services.

11. Governing Law

• These Terms are governed by and construed in accordance with the laws of Texas/USA.

• Any disputes arising from these Terms will be resolved in the courts of Texas Judicial Branch-Business Court 11.  

12. Changes to These Terms

• We may update these Terms from time to time.

• We will notify you of any changes by posting the new Terms on our website and updating the "Last Updated" date.  

• Your continued use of our services after any changes constitutes your acceptance of the revised Terms.
